利用規約Terms of Service

1. 適用1. Scope

本規約は、artrim（artrim.app および app.artrim.app、以下「本サービス」）の利用に関する一切に適用されます。本サービスに登録した時点で、本規約に同意したものとみなします。 These terms apply to all use of artrim (artrim.app and app.artrim.app, the "Service"). By creating an account you agree to these terms.

2. アカウント2. Your account

• 正確なメールアドレスをご登録ください。Register with an accurate email address.
• パスワードの管理はお客様の責任で行ってください。第三者に知られた場合は速やかに変更してください。You are responsible for keeping your password secure. Change it promptly if it may have been exposed.
• アカウントを他人に貸与・譲渡することはできません。複数人で使う場合は、メンバー招待の機能をご利用ください。Do not lend or transfer your account. To work with others, use the member invitation feature.
• 18歳未満の方は、保護者の同意を得たうえでご利用ください。If you are under 18, use the Service with the consent of a parent or guardian.

3. 料金と支払い3. Fees and payment

• 登録から30日間は無料でご利用いただけます。クレジットカードの登録は不要です。The first 30 days are free. No credit card is required to start.
• 有料プランの料金は、特定商取引法に基づく表記に記載のとおりです。Paid plan prices are set out in our commercial transactions notice.
• お支払いは Stripe を通じたクレジットカード決済です。当社がカード番号を保持することはありません。Payment is by credit card via Stripe. We never store your card number.
• 残っている無料期間は、有料プランに申し込んだ後もそのまま引き継がれます。Any remaining free days carry over when you subscribe.
• 料金を改定する場合は、30日前までにメールでお知らせします。改定に同意されない場合は、その前に解約できます。If we change prices, we will email you at least 30 days beforehand. You may cancel before the change takes effect.

4. 解約4. Cancellation

いつでも解約できます。解約すると次回以降の課金は停止し、支払い済みの期間の末日まではそのままご利用いただけます。日割りでの返金は行っておりません。 You may cancel at any time. Cancelling stops future charges; you keep access until the end of the period you have paid for. We do not issue pro-rated refunds.

無料期間が終了しても、あるいは解約した後でも、登録済みのデータの閲覧と CSV での書き出しは引き続きできます。停止するのは新しい作品の追加だけです。お客様のデータを人質に取ることはしません。 Even after the free period ends, or after you cancel, you can still view your data and export it as CSV. Only adding new works stops. We will not hold your data hostage.

5. お客様のデータと著作権5. Your data and copyright

• お客様が登録した作品情報、画像、資料（以下「お客様データ」）の権利は、すべてお客様（または正当な権利者）に帰属します。当社がその権利を取得することはありません。All rights in the works, images and documents you upload ("Your Data") remain yours (or the rightful owner's). We acquire no rights in them.
• 当社は、本サービスを提供する目的（保存、表示、サムネイルの生成、お客様が作成した共有リンクを通じた第三者への表示、バックアップ、障害からの復旧）に必要な範囲でのみ、お客様データを取り扱います。We handle Your Data only as needed to run the Service: storing it, displaying it, generating thumbnails, showing it to people you send a share link to, backing it up, and restoring it after a failure.
• 当社は、お客様データを広告、宣伝、機械学習の学習用途、その他の目的に利用しません。第三者に販売・提供することもありません。We do not use Your Data for advertising, marketing, machine-learning training, or any other purpose. We do not sell it or pass it to third parties.
• 当社の従業員がお客様データを閲覧するのは、お客様からの依頼にもとづく調査、または法令にもとづく場合に限ります。Our staff access Your Data only when you ask us to investigate something, or when required by law.
• お客様は、登録する画像や資料について、必要な権利を有していること（または権利者の許諾を得ていること）を保証してください。You confirm that you hold the necessary rights to the images and documents you upload, or have the rights holder's permission.

6. 共有リンク6. Share links

お客様は、選んだ作品を1つの URL で共有できます。この URL を知っている人は誰でも、その内容を見ることができます。送り先を誤らないようご注意ください。共有リンクはいつでも無効にできます。 You can share selected works via a single URL. Anyone who knows the URL can see the contents. Please take care where you send it. You can revoke a share link at any time.

7. 禁止事項7. What you may not do

• 法令や公序良俗に違反する行為Break the law, or act against public order and decency.
• 他人の権利（著作権、肖像権、プライバシー等）を侵害する行為Infringe anyone's rights, including copyright, likeness and privacy.
• 本サービスに過度な負荷をかける行為、不正アクセスの試み、リバースエンジニアリングOverload the Service, attempt unauthorised access, or reverse-engineer it.
• 本サービスを再販売・転貸する行為Resell or sublicense the Service.

8. サービスの変更・停止8. Changes and interruptions

保守や障害対応のため、事前の告知なく一時的にサービスを停止することがあります。可能な限り事前にお知らせします。 We may pause the Service temporarily for maintenance or to deal with faults, sometimes without notice. We will tell you in advance where we can.

本サービスを終了する場合は、90日前までにメールでお知らせします。終了後も90日間はデータを書き出せる状態を保ち、その後に消去します。 If we discontinue the Service, we will email you at least 90 days beforehand. We will keep your data exportable for 90 days after the end date, then delete it.

9. 退会9. Deleting your account

退会をご希望の場合は info@biscuitgallery.com までご連絡ください。退会後、お客様データは30日間保持したうえで消去します。この期間内であれば復旧できます。 To delete your account, email info@biscuitgallery.com. After deletion we keep Your Data for 30 days, then erase it. You can restore it within that window.

10. 免責10. Limits of our liability

当社は、本サービスに事実上または法律上の瑕疵がないことを保証するものではありません。当社の故意または重過失による場合を除き、本サービスの利用に関して生じた損害について、当社が負う賠償責任は、直近12か月間にお客様が実際に当社へ支払った金額を上限とします。 We do not warrant that the Service is free of defects. Except in cases of our wilful misconduct or gross negligence, our total liability for any loss arising from your use of the Service is limited to the amount you actually paid us in the preceding 12 months.

データの保護には最善を尽くしますが、お客様ご自身でも定期的に CSV の書き出しによるバックアップを取ることを強くおすすめします。 We do our best to protect your data, but we strongly recommend you also keep your own backups by exporting to CSV regularly.

11. 規約の変更11. Changes to these terms

本規約を変更する場合は、変更後の内容をこのページに掲載します。お客様に重大な影響を与える変更については、30日前までにメールでお知らせします。 If we change these terms, we will post the new version on this page. For changes that materially affect you, we will email you at least 30 days beforehand.

12. 準拠法・管轄12. Governing law

本規約は日本法に準拠します。本サービスに関して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。 These terms are governed by the laws of Japan. Any dispute will be submitted to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
